The situation

A rental that outlived the plan

My sellers had converted a former primary residence into a rental nearly a decade earlier, planning to eventually move back. Life moved on, the property no longer served them, and they decided to sell.

The home was tenant-occupied, and the tenants had no agent of their own. That combination is where deals usually get adversarial, slow, or both.

The approach

Compliance first, then creativity

Maryland's Tenant Opportunity to Purchase Act gives tenants specific rights in a sale, and I built the process around complying with it fully. I coordinated directly with the tenants' lender to confirm they could qualify, and priced the home using its condition and closed comps rather than wishful thinking.

The structure that emerged was simple and honest: the tenants, who had not planned on buying, would purchase the home they already lived in.

The sellers received their asking price. The tenants became homeowners without moving a single box. Nobody lawyered up, nobody walked away burned, and the transaction closed with every party satisfied.

What made the difference

Legal complexity is usually treated as a reason to slow down or steer around a deal. Treating TOPA as the framework for the deal, rather than an obstacle to it, produced an outcome where both sides genuinely won.
